Plain English summary
These are the rules we trade by. They apply every time you sell scrap to us, drop off an end-of-life vehicle, hire a bin, or book a mobile collection. They are written in plain English so you can read them in five minutes.
The headlines:
- Prices change daily. The rate on the yard wall on the day you weigh in is the rate you get paid.
- Our weighbridge is the final word on weight. It is a certified scale.
- We must see government ID. Victorian law gives us no flexibility on this.
- We do not pay cash for scrap metal. Payment is by EFT or cheque.
- You must own what you sell us. By selling, you confirm you do.
- We can refuse any load if something does not look right.
The rest of this page is the detail.
1. Who you are dealing with
You are dealing with Brothers Scrap Recycling Pty Ltd (ABN 44 694 523 156), a licensed Victorian scrap metal recycler, trading from 9 Balmoral Avenue, Dandenong VIC 3175.
These terms apply to:
- Drop-off sales at the yard.
- Mobile collection at your site.
- Bin hire and bin pickup.
- End-of-life vehicle sales.
- Commercial scrap accounts.
If you trade with us, you accept these terms. If you do not accept these terms, do not trade with us.
Quotes, daily rates and pricing
- Quotes are indicative. Any phone, web, SMS or email price we give before we see and weigh the metal is an estimate based on what you tell us. It is not a binding offer.
- Rates are set daily and posted on the yard wall. Prices for copper, aluminium, brass, steel, lead, cables, batteries and other materials move with the global commodity market. The rate that applies to your load is the rate posted on the day your metal is weighed in, not the day you booked.
- Grading. Our yard team grades each load before payment. Grade is decided by visual inspection against industry-standard categories (for example, bare bright copper, copper number one, copper number two, low-grade copper). Contamination, paint, insulation, fittings and moisture all change the grade and the price. We will tell you the grade we have applied before the weigh-in is final.
- The weighbridge is final. Our weighbridge is certified to the National Measurement Institute (NMI) standard. The recorded weight is the final weight for payment. If you disagree with a grade or a weight, you must raise it before you leave the yard.
- Quote before weigh. We are happy to give you a quote and a grade walk-around before your metal hits the scale. Ask at the gate.
Identification (mandatory)
Under the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic), we are required to record the identity of every person who sells scrap to a licensed dealer.
You must present one current, government-issued photo ID at every transaction, including every mobile pickup. We will record:
- Your full name.
- Your residential address.
- Your date of birth.
- The type and number of the ID.
- A scan or photograph of the ID.
Acceptable ID includes an Australian driver licence, a Victorian learner permit, a Proof of Age card, a Keypass card or an Australian or foreign passport.
If you cannot or will not provide ID, we cannot lawfully buy your metal. Please do not ask staff to make an exception. There is no exception we are legally allowed to make.
Payment
- No cash for scrap metal. We do not pay cash for scrap metal. All payments are made by EFT (electronic funds transfer) to a bank account in your name, or by cheque made out to you. This is consistent with Victorian scrap metal compliance practice and our internal audit policy.
- EFT details. You will need to provide your BSB and account number at the weighbridge. The account must be in the same name as the ID you have presented. We do not pay into third-party accounts.
- Timing. EFT payments are processed the same business day where possible, and at the latest within one business day of the transaction. Bank clearing times are outside our control.
- Cheques. Cheque payment is available on request.
- Receipts. Every transaction is receipted at the weighbridge. The receipt shows the date, the weights, the grades, the rate per kilogram or per tonne, the total, and the payment reference.
Title and ownership warranty (seller’s warranty)
When you sell scrap or a vehicle to us, you warrant the following to be true:
- You are the legal owner of the metal or the vehicle.
- The metal or the vehicle is free of any security interest, finance, lien or third-party claim.
- The metal or the vehicle is not stolen and has not been obtained by fraud or unlawful means.
- You have the legal right to sell.
- The information you have given us, including ID, is true and current.
If any of these warranties turns out to be false, you indemnify Brothers Scrap Recycling against any loss, claim or cost we incur as a result.
Refusal, hold and reporting
We may, at our absolute discretion:
- Refuse any load, in part or in full.
- Refuse any vehicle if ownership cannot be verified.
- Hold a load aside, without payment, pending verification.
- Report any load that we reasonably suspect to be stolen, mis-described or sourced from utility infrastructure (for example, copper cable that appears to be stripped from live infrastructure) to Victoria Police.
We may also refuse a load if the person attempting to sell is intoxicated, behaving aggressively at the yard, or refusing to comply with site rules.
End-of-life vehicles
In addition to the general terms above, the following applies to end-of-life vehicles (ELV).
- Ownership documents. You must produce one of: a current Victorian registration certificate in your name; a registration transfer slip in your name; or, where the vehicle is unregistered, evidence of ownership we are satisfied with (typically a previous registration document plus a clear PPSR result).
- Transfer of ownership. You must sign our written transfer of ownership at the point of sale. Title in the vehicle passes to Brothers Scrap Recycling on signing and payment.
- Disposal notice. Where required, we will lodge a disposal notice with VicRoads. You should also separately notify VicRoads.
- Depollution. End-of-life vehicles are depolluted in line with the Environment Protection Act 2017 (Vic) and the Environment Protection Regulations 2021 (Vic). Fuel, oil, coolant, brake fluid, refrigerant gas, batteries, mercury switches and airbag charges are removed and handled by licensed operators before the vehicle body is processed.
- Personal belongings. Remove every personal item before the vehicle is collected or dropped off. Once title passes, the vehicle and its contents become our property. We will dispose of any contents in the normal course of processing and we are not liable for them.
- Plates. Remove the registration plates and return them to VicRoads. If you ask us to remove them for you, we will, but the obligation to return them rests with you.
Mobile collection
- Booking. Mobile collections are booked by phone on +61 420 332 222 or through the website. The booking sets a service window, not a fixed minute.
- Service area. We service Melbourne’s south-east and major surrounding suburbs. We will confirm the suburb on booking.
- Minimum loads. A minimum load may apply for free pickup. Below the minimum, a callout fee may apply or we may decline the booking. We will tell you on booking, not on arrival.
- ID on site. ID requirements at section 3 apply at the pickup site, not later. Have your ID ready when our driver arrives.
- Site access. You must give us safe, lawful access to the metal. We do not enter unsafe roofs, locked sites without authorisation, or contaminated areas without notice.
- Quote on site. The driver will quote your load on site at the day’s rate. If you accept, the metal is weighed at our weighbridge and payment follows under section 4.
Bin hire
- Drop and pickup. We deliver and collect roll-on, roll-off and skip bins to a site you nominate.
- Contamination. Only the metal grade booked may go in the bin. If the bin comes back with non-metal contamination (plastic, household waste, asbestos, dirt, concrete, oil, food waste, tyres, mattresses, gas bottles), a contamination charge will apply. The charge is set on the day, based on the cost of sorting or landfill disposal. We will tell you before we apply it.
- Site responsibility. You are responsible for the bin while it is on your site. This includes loading safely, not overloading, locking access where appropriate, and any council permit needed for a kerbside bin.
- Damage. You are responsible for damage to the bin caused by misuse, fire, paint, or contents that should not have been loaded. Fair wear and tear is on us.
- Pickup notice. Standard pickup is within one business day of your call. Same-day pickup may be available. The booking line will confirm.
Commercial accounts
For tradies, demolition contractors, manufacturers, councils, government and large recurring suppliers, we offer commercial accounts with regular pickups, ticketed weighbridge runs and consolidated invoicing.
- Account application. Commercial accounts must be approved by Brothers Scrap Recycling in writing. We may ask for an ABN, a director ID and a credit reference.
- Authorised representatives. You must give us a list of the people authorised to sell scrap on the account’s behalf. Each of those people is still required to present ID at the weighbridge or at the pickup.
- Statements and payment terms. Commercial accounts are paid by EFT on the standard payment cycle agreed when the account was opened. Default payment terms are end of week of weigh-in.
- Disputes. Any dispute about a weigh, a grade or a price must be raised in writing within seven days of the weigh date.
Site rules
When you visit the yard, you agree to:
- Follow the directions of yard staff at all times.
- Wear closed-in shoes. Sturdy work boots and high-visibility clothing are strongly preferred.
- Keep children inside the vehicle. The yard is an industrial workplace, not a public space.
- Not smoke or use open flame anywhere on the site.
- Not climb on bins, trucks, the weighbridge or stockpiles.
- Stop your vehicle on yard staff direction.
The yard is under CCTV at all times. Footage is used for safety, theft prevention and dispute resolution.
Hours and access
Trading hours are Monday to Saturday, 8.00am to 6.00pm. The yard is closed on Sunday and on Victorian public holidays. Hours may change with reasonable notice, posted at the gate and on the website.
The last weigh of the day is at 5.45pm to allow paperwork to be completed before close.
Liability and consumer rights
- Australian Consumer Law. Nothing in these terms limits or excludes any consumer guarantee under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
- Cap on liability. To the extent permitted by law, our total liability to you for any one transaction is limited to the amount we paid you, or should have paid you, for the metal in that transaction.
- No indirect loss. We are not liable for any indirect, consequential or business loss, including loss of profit, loss of opportunity, or loss caused by delay, except where the law does not allow this exclusion.
- Industrial site. You enter the yard at your own risk, in line with our site rules. We carry public liability insurance, but you remain responsible for following safety directions.
Privacy
We collect, hold and use personal information in line with our Privacy Policy. By trading with us, you confirm you have read the Privacy Policy and accept how we handle your information.
Force majeure
We are not liable for failure to perform any obligation under these terms where the failure is caused by an event outside our reasonable control. Examples include power outage, weighbridge calibration failure, severe weather, fire, industrial action, fuel shortage, pandemic public health order or government direction.
We will let you know as soon as practical and reschedule pickups or weighs as required.
Changes to these terms
We may change these terms from time to time. The current version is always on this page, with the effective date below. The version in force on the day of your transaction is the version that applies.
Governing law
These terms are governed by the law of the State of Victoria, Australia. The Victorian courts have exclusive jurisdiction over any dispute arising under them.
