Privacy Policy

Our promise

Brothers Scrap Recycling Pty Ltd (ABN 44 694 523 156) is a Victorian scrap metal recycler. We take the privacy of our customers, suppliers and website visitors seriously. This policy explains what personal information we collect, why we collect it, how we use and protect it, and the rights you have over it.

This policy is written to comply with the Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles (APPs). It also covers the personal information we are required to collect and hold under the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic), which applies to every licensed scrap metal dealer in Victoria.

By selling scrap to us, hiring a bin from us, booking a mobile collection, dropping off an end-of-life vehicle or using this website, you agree to the practices set out in this policy.

Who this policy applies to

This policy applies to:

  • People who sell scrap metal to us, in person, by drop-off, by mobile collection or by bin hire.
  • People who sell an end-of-life vehicle to us.
  • Commercial account holders and their representatives.
  • People who fill in a form, send an enquiry, request a quote or call the yard.
  • Visitors to our website and our social media pages.

What personal information we collect

We only collect what we need to run a safe, legal and traceable scrap business. The information we collect falls into five groups.

1. Identity information required by Victorian law.

For every scrap metal transaction, the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic) requires us to record:

  • Your full name.
  • Your residential address.
  • Your date of birth.
  • The type and number of a current government-issued photo ID (typically an Australian driver licence, learner permit or passport).
  • A photograph or scanned image of the ID at the time of the transaction, where required.
  • For vehicle metal: the registration number and a description of the vehicle delivering the scrap.

This information is collected at the weighbridge or at the gate before any payment is made. We cannot accept scrap without it.

2. Transaction information.

  • Date, time and yard location of the transaction.
  • Material type, weight, grade and price per kilogram or per tonne.
  • The total amount paid.
  • The payment method (EFT or cheque, see Trading Terms below).
  • Your bank account details where you are paid by EFT.
  • Any receipt or invoice number.

3. End-of-life vehicle information.

In addition to the items above, for an end-of-life vehicle we also collect:

  • Vehicle make, model, build year, VIN and registration plate.
  • Evidence of ownership (current registration certificate, transfer papers or PPSR result).
  • A signed transfer of ownership form.
  • Any disposal notice required to be lodged with VicRoads.

4. Contact and enquiry information.

  • Your name, phone number and email address.
  • The suburb you want a pickup from, or the suburb you trade in.
  • Photos of the metal you send through our enquiry channels.
  • The content of any message, voicemail or email you send us.
  • For commercial accounts: business name, ABN, billing address and authorised signatory.

5. Website, marketing and security information.

  • Your IP address, browser type, device type and pages you view (collected through standard server logs and Google Analytics 4).
  • Cookies and similar technologies, as described in the Cookies and Tracking Notice.
  • Marketing preferences you give us, including subscription to any email update list.
  • CCTV footage of the yard, the weighbridge and the gate. The yard is under continuous CCTV recording for safety, theft prevention and legal compliance. Signs are displayed at every entry point.

How we collect it

We collect personal information directly from you in most cases. The main collection points are:

  • At the gate or weighbridge, when you arrive to sell scrap or drop off a vehicle.
  • When you book a mobile pickup or a bin by phone, email, web form or social media message.
  • When you set up a commercial account.
  • When you sign a vehicle transfer.
  • Through CCTV at the yard.
  • Through the website (forms, cookies, analytics).

Sometimes we collect information about you from third parties. For example, from VicRoads or PPSR when verifying vehicle ownership, from your bank when processing an EFT payment, or from Victoria Police where we are responding to a lawful information request about suspicious or stolen goods.

Why we collect it

We collect personal information for the following purposes:

  • To comply with the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic) and any related regulations, including police record-keeping obligations.
  • To verify that the person selling the scrap or the vehicle is the lawful owner.
  • To process payment to you.
  • To prevent and detect theft of scrap and trade in stolen metal.
  • To run our weighbridge, yard and bin hire operations safely and accurately.
  • To respond to your quote requests, callbacks and bookings.
  • To manage commercial accounts and invoicing.
  • To send you marketing about our services, but only where you have opted in.
  • To improve our website, our service times and our customer experience.
  • To respond to lawful requests from Victoria Police, the EPA, VicRoads, the Australian Taxation Office or other regulators.

The lawful basis for collecting ID

Under Victorian law, a licensed second-hand dealer cannot buy scrap metal without recording the seller’s identity. This is a mandatory legal obligation, not a Brothers Scrap Recycling business choice. Records are kept in a tamper-evident transaction register and are available for inspection by Victoria Police at any time.

If you choose not to provide the required ID, we cannot lawfully buy your scrap. There is no work-around.

How we hold and protect your information

Records are held in two systems.

  • A locked, access-controlled weighbridge transaction system at the yard.
  • A locked filing area for paper records, including signed vehicle transfer forms.

Both are kept on the yard premises at 9 Balmoral Avenue, Dandenong, and are only accessible to authorised staff. Digital backups are held in encrypted cloud storage hosted within Australia. CCTV footage is held on a local recorder and is overwritten on a rolling cycle, except where retained for a specific incident.

We require everyone on our team who handles personal information to keep it confidential. They are only allowed to use it for the purpose it was collected.

Who we share it with

We do not sell, rent or trade your personal information.

We share personal information only in the following circumstances:

  • Victoria Police. Our transaction register is available to Victoria Police on request, as required by the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic). We will provide CCTV and weighbridge records on lawful request.
  • VicRoads, the EPA and other regulators. Where required for vehicle disposal notices, depollution audits, environmental compliance or tax compliance.
  • Our bank and payment processors. To pay you by EFT or cheque.
  • Our accountant and bookkeeper. Under written confidentiality.
  • Our website and IT providers. For the limited purpose of running our website, email and booking systems. These providers are bound by their own privacy obligations.
  • Insurers and legal advisers. Where strictly necessary to manage a claim or seek advice.
  • A buyer or assignee. If we ever sell the business, customer records may transfer with it. The buyer will be required to honour this policy.

We do not disclose personal information overseas, except where a cloud service provider routes data through an offshore data centre as part of normal global infrastructure. In those cases we use providers with recognised Australian Privacy Principle commitments.

Marketing

We will only send you marketing emails or messages if you have given us your contact details and either opted in or are an existing customer who would reasonably expect to receive them.

Every marketing email includes a one-click unsubscribe link. You can also unsubscribe by replying with the word UNSUBSCRIBE or by calling +61 420 332 222. We will action your request within five business days.

This complies with the Spam Act 2003 (Cth).

Cookies, analytics and website tracking

The Brothers Scrap Recycling website uses cookies and similar technologies to make the site work properly and to understand how it is being used. The full details, including what we use, how to switch them off and which third parties are involved, are in our separate Cookies and Tracking Notice.

  • Ask for a copy of that information.

To exercise any of these rights, contact us using the details at the bottom of this policy. We will respond to your request within thirty days. There is no charge for a reasonable request.

There are limited cases where we cannot delete or hand over information. The main one is the transaction register we are legally required to keep under Victorian scrap metal laws. We cannot delete that record, even at your request, until the legal retention period has passed.

  • Marketing contact list: until you unsubscribe.
  • Quote and booking enquiries that do not lead to a transaction: up to twelve months.
  • Commercial account records: seven years after the account closes.

After these periods, we destroy or de-identify the information.
